Defective Products

WHAT IS A DEFECTIVE PRODUCT?

By law, a defective product means that a product (medicine, toy, paint or other item) has a tendency to cause harm beyond what would be expected by ordinary use from an ordinary user. To simply that statement, if you have used a product for its intended use and have suffered an injury, the product is deemed defective.  American law states that manufacturers, distributor, retailers and all others who make products available for public uses are responsible for the products safety. If a product is found to be dangerous it is the responsibility of the business to take action to protect the consumers. Sometimes defective products are recalled before any harm can be done. However, all too often this is not the case. Defective products kill and injure innocent people every day and can disrupt the lives of victims and their families.

EXAMPLES OF DEFECTIVE PRODUCTS

  • Children’s toys
  • Automobile parts
  • Food and Agricultural products
  • Medical Products and Devices
  • Recreational Products
  • Tobacco
  • Pharmaceutical Products
  • Machinery and Tools

PRODUCT LIABILITY

Product Liability falls under Tort Law. The United State Department of Commerce has instituted the Model Uniform Products Liability Act but this is for voluntary state usage. Federal law does not control product liability laws; Oklahoma state law solely controls all the legal happenings with defective product cases. Since the product has caused unreasonable harm, the manufactures of these products are liable to compensate victims for their suffering.
